Welcome to the EUPHALLIC website. The following outlines the terms and conditions (our "Terms of Use") by which VitaCore Laboratories LLC (referred to herein as "VCL", "us" or "we") offers services and information on or through this website. Please review these terms carefully.
This Agreement sets forth the terms and conditions which apply between VCL and you ("you" or "Customer") of the VCL Sites (as defined below) and any other subscription product or service offered for sale by VCL and/or its affiliates (collectively, "VCL"). The right to use any product or service offered by VCL is personal to you and is not transferable to any other person or entity. At any time and without notice, VCL has the right to make changes to the VCL sites, policies, and these terms.
If you are not 18 years or older, please ask your parent or guardian for permission to use this website and to order goods from it. There may be local laws that make it inappropriate for you to use this site, or make purchases from it. You and your parent or guardian will be solely responsible for determining if you may use this site lawfully.
1. Use of Sites.
Through use of the VCL websites, customers may link to other websites, resources and advertisers. Such links are provided for convenience and/or information purposes only. A link does not constitute an endorsement of content, viewpoint, policies, products or services of that website. VCL is not, under any circumstances, to be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to a user in connection with the use of or reliance on any content, goods or services available on such external site. Those concerns are the responsibility of the external site's administrator or webmaster.
2. Disclaimer of Warranty; Limitation of Liability.
VCL attempts to maintain the highest accuracy of content on its Web site. Any errors or omissions should be brought to our attention immediately. VCL makes no claims, promises, or guarantees about the absolute accuracy, completeness, or adequacy of the contents of this Web site and expressly disclaims liability for errors, omissions and offensive or defamatory language in the contents of this Web site. The VCL sites are provided on an “as is” and “as available” basis. Any use of or reliance on this site or the contents of this site shall be at your sole risk; VCL will under no circumstances be liable for any loss or damage caused by use of information contained within these sites. VCL and its affiliates shall not be liable for any damages arising from interruption, suspension or termination of the website, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so some of the above limitations may not apply to you. The customer is solely responsible for evaluating the completeness, accuracy and usefulness of any information, opinion, advice or other content available through the VCL sites. The information contained on this site is intended as a supplement to, and not a substitute for, the knowledge, expertise, skill, and judgment of physicians, pharmacists, or other healthcare professionals in patient care. Please seek the advice of professionals, as appropriate, regarding the evaluation and use of any of the content provided on VCL websites.
3. Indemnification.
The customer agrees to defend, indemnify and hold harmless VCL, its affiliates, licensors and suppliers, and their directors, officers, employees, agents and contractors from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, the customer’s violation of these Terms of Use.
4. Electronic Communications.
The customer communicates with VCL electronically whenever he or she visits the VCL sites or sends e-mails to VCL. By doing so the customer hereby consents to receive electronic communications from VCL. VCL will use the VCL sites to communicate with the customer by posting notices, or will communicate with the customer via e-mail. The customer agrees that these electronic communications from VCL, including but not limited to agreements, notices and disclosures, satisfy any legal requirement that such communications be in writing.
5. Modifications.
All content and information contained on the VCL sites might be changed or updated without notice. VCL might also make changes or improvements at any time without notice, and may discontinue any or all of the Website and/or any or all products, features, prices of products or information appearing on or available through any or all of the Website, temporarily or permanently, with or without notice to you. VCL will not be liable to the customer or any third party for any changes to the Website, as described above.
6. Submission of Information or Materials.
The customer is responsible for providing true, accurate and complete information when submitting personal data to VCL. By providing this information, the customer also agrees to keep it current and promptly update any such information to keep it accurate. The customer must not impersonate or otherwise mislead by using a false e-mail address, false name or false identification details. If you transmit or post any ideas or other materials to the VCL sites and VCL decides to use these for any purpose, VCL is not obligated to offer compensation to you or anyone else. Defer solely to your rights under patent, trademark, and copyright laws. The right of VCL to contest the validity of your patent, trademark or copyright will in no way be impaired by VCL’s receipt or consideration of your material.
7. Shipping.
Euphallic orders received Monday through Thursday before 1:00 PM (PST) are usually fulfilled and shipped the next business day. We don't ship on Saturday's and Sunday's, so orders placed on Friday's and Saturday's will be shipped on the next business day, excluding holidays. Unless expedited shipping is requested, orders ship via Standard Ground (within the continental U.S.) and usually arrive within 1-2 weeks. Expedited (RUSH) ship via USPS Priority, and arrive within 2-3 business days. International orders ship via USPS and usually arrive between 14-21 business days from date of shipment, pending customs approval.
VCL’s distribution center quantities are kept low and each order is processed as soon as possible to insure that only the freshest possible product gets delivered to your door. If we are forced to reship your order because you provided an incorrect address, you will be charged an additional shipping and handling fee.
8. Cancellation Policy.
Your credit card will be charged as soon as you submit an order and receive confirmation through the Euphallic website. Due to our streamlined order-processing system and high volume of orders we are unable to cancel an order after submitted, with no exceptions.
9. 60 Day Return Policy.
Your complete satisfaction with Euphallic is our ultimate goal. Our 60 Day Return Policy guarantees that if you are not 100% satisfied with your purchase of Euphallic you may return the box to VitaCore Laboratories LLC and receive a refund.
The following conditions apply:
- One used or unused box purchased from VitaCore.com can be returned for any reason within sixty (60) days of your purchase.
- Credits will be issued for ONE unopened box or ONE opened box. Credits will NOT be issued for the 7-day supply.
- One return per customer.
- Shipping and handling fees will not be refunded.
- A $10.00 restocking fee will be charged for the box. (Example: If you purchase a box of Euphallic at $72.95, and return it unopened, your refund will be $62.95 ($72.95 less the restocking fee of $10).
- You need a Return Authorization to return your merchandise. Product returned without proper documentation (including the RMA number) will not be refunded.
- Click here to request the Return Authorization (RMA).
- Complete and submit the online form, being sure to provide all of the information requested about your order and reason for your dissatisfaction with the product.
- Once your eligibility for a refund has been verified by VitaCore Customer Service, you will receive your RMA number via email. The RMA will include directions for your return shipment, including RMA number and the return shipping address.
- The customer is responsible for all return shipping and handling charges.
- Returned product must be received at the VitaCore Laboratories return address within sixty (60) days of the original purchase date.
- If the above conditions are met, within thirty (30) days of return receipt, VitaCore Laboratories will issue a refund for the product purchase price minus the restocking charge. Confirmation will be sent via email.
- We encourage you to try our product, but must limit refunds to one per customer.
- VitaCore Laboratories LLC reserves the right to reject any return that does not comply with these requirements.
- 7-day supply is non-refundable.
- We do not accept COD's.
10. Platinum Club
As a Platinum Club member, you will automatically receive a new 30-day supply of Euphallic every month at a discounted price of $46.95, plus shipping/handling (that's a $25 savings!). There are no obligations and if you are unhappy for any reason, you can cancel at any time by calling customer care 1-800-630-4102.
11. Sales and Distribution.
Prices do not include and are net of any foreign or domestic governmental taxes or charges of any kind that may be applicable to the sale, licensing, marketing or distribution of the products. VCL understands that all sales are final and they are not entitled to return any product for a refund. VCL is not responsible for any delays or lack of delivery due to customs clearance issues.
12. Domestic Use/ Export Restriction.
The VCL websites are controlled from our offices within the United States of America. We make no representation that the Website or its content (including, without limitation, any products or services available on or through the Website) are appropriate or available for use in other locations. Users who access the Website from outside the United States of America do so on their own initiative and must bear all responsibility for compliance with local laws, if applicable. Further, the United States export control laws prohibit the export of certain technical data and software to certain territories. No content from the Website may be downloaded in violation of United States law.
13. Applicable Law/Jurisdiction.
The laws of the United States and the State of California will govern all claims and disputes relating to your access the VCL Websites, these Terms of Use, and the relationship between VCL and the customer, without regards to California's conflict of laws principles. You agree to the personal jurisdiction by and venue in the state and federal courts in Los Angeles County, California, and waive any objection to such jurisdiction or venue.
14. Legal Disclaimer.
Statements made by VCL have not been evaluated by the U.S Food and Drug Administration. The FDA does not evaluate or test herbs. Herbs or traditional natural remedies cannot treat, prevent or cure a medical condition. The information contained here is not intended as a cure, treatment or to diagnose any disease; it is for use in the maintenance and promotion of good health in cooperation with a licensed medical practitioner.
